    Remember back in 2017 when John Oliver did a Last Week Tonight segment about coal company CEO and “geriatric Dr. Evil” Bob Murray, then - as predicted - was sued by Bob Murray the following week? Oliver couldn’t discuss the lawsuit while it was ongoing, but we did get an update when the case was dismissed in February 2018, when Oliver, referencing the original segment, told Murray to “eat shit.” What you might not know, however, is that Murray appealed the case after it was dismissed, so Oliver was yet again forced into silence until the case was recently dropped. Which brings us to last night’s Last Week Tonight, when Oliver was finally free to recap the entire saga … and, in doing so, to start a whole new saga too.

      @Malakkar Vohryzek: Another thing: Hiring an attorney means you are personally responsible if you hire one who is incompetent, whereas being assigned an attorney means "The System" has failed you if you are assigned one who is incompetent. Who would accept an unfavorable outcome of a lawsuit if they believe "The System" betrayed their best interests and set them up to lose? Nobody. "The System" is more trustworthy if its responsibility is limited in scope, and it is of the utmost importance that the courts be considered trustworthy.

      @Shawn Elliott no one hires their emergency room doctor, which arguably, is the most important person to hire based on ability. If you're picky, what's stopping you from doing an interview with an appointed attorney, and recusing based on answers?
      Also, you don't get to hire police, ambulances or firemen, are you arguing that you should be able to, and that if you were able to, somehow emergency response would be better?
      Your examples just do not make sense. If people can't recognize in advance that their attorney is not going a good job, so recusal or disqualification isn't a good methodology for getting rid of a bad attorney, what does being able to hire them with money change?
      Are you saying that the act of hiring, makes one more capable of evaluating their attorney's performance? How? How does hiring them, make one more prescient of ability and pre-evaluation of performance?
      I simply don't understand what your position is here...

      @Malakkar Vohryzek: Recusing or disqualifying your attorney requires that you know enough about the proceedings to recognize in-advance that they will not do a good enough job. Unless you get sued on a regular basis you will not have the requisite experience to evaluate your attorney's competence before the verdict is rendered.
      I'm not saying everyone should have to pay for their own attorney. It's good that we have public defenders. But they should not be the only option. Extremely picky people who don't trust experts by default, such as myself, should be allowed to hire their own attorneys if they can afford to, just like we also do with doctors.

      @Shawn Elliott so our jury system doesn't work? You can use a similar system to recuse or disqualify an attorney for misconduct, or lack of effective assistance of counsel.
      There's even a standard for it, it's called Strickland v. Washington.
      However, more importantly, your example leads one down some very treacherous pathways, using the same justification you have -- when was the last time you decided which military personnel you want to hire to handle our national defense? Or hired your own prosecutor?
      Do you have to tell 911 which EMTs are acceptable to provide your emergency health service, or which firefighters are to come over and combat the blaze, if your home is on fire, or which police officers command an appropriate hourly rate, that they can properly enforce the law, or investigate a crime, in order to be responsible?

      More importantly, taking responsibility for hiring a good attorney, when the base line for hiring an attorney is $350 an hour, is comical. A "good" attorney will likely charge 750-950 an hour. Median income in the U.S. is like $42,000. After taxes, that's $32,000 more or less. After housing and living expenses, that's about $16,000 leftover. With no car, no medical, nothing else, you can afford the average attorney, at $500 an hour, is 32 hours.
      So if any case requires more than 32 hours in a year, you are unable to take personal responsibility for hiring a good lawyer, because you do not have the economic means. Unless you're of the camp that says, equality means both rich and poor are free to live under a freeway overpass. A camp I thoroughly reject, and a rationale that is literally without any sense behind it.

      @Malakkar Vohryzek: Socializing law only works if all attorneys are equally competent. Otherwise you're asking people to hope they are assigned a good attorney, rather than taking personal responsibility for hiring a good attorney.

    Interesting. It is quite different from New Zealand, which is similar to UK/AUS system. It is quite hard to sue anyone in New Zealand. We also have something called "Disputes Tribunal", which isn't like a formal court. You usually represent yourself in a hearing - a lawyer can’t represent you, and there are no judges. It is for settle small claims up to $30,000.

    Not gonna lie, from a french guy's perspective: Having to pay your attorney's fees even in the case of a successful defense is a definite factor in why people around the world think that the US' system is... Well, lacking if we put it kindly, and plain flawed if I'm being honest. I get it, you're the capitalists and all that jazz, but money really doesn't need any more power than it currently has.

    Lawyers are a waste of time I tried to get one to repent me no luck I end up taking two meds that have been proven to cause pancreatitis now I have severe acute pancreatitis that can turn into cancer I ask a lawyer about it nothing they can due but if it turn into cancer now that a lawsuit

    So question..may I approach the bench.. Thank you. So attorneys fees in the US. Is it legal lets say with a custody suit to put in the paperwork that if you lose you pay the fees for the other party?? Again this is in the US and not concerned with any other country. Any input is appreciated

    Trump is the master of SLAPP suits. People who he owes money to for a lot of contracting work have tried to sue him to make him pay their bills, and he just overwhelms them with lawyers and extended trial situations. Until eventually these people who EARNED the money Trump owes them, have no choice but to quite, because they run out of money. Trump is also forcing people to sign NDAs when there is no reason for it. No legal bases for it.
    I believe Stormy. And I have a lot of Actual Malice towards Trump.

    As someone from a civil law country: the american system of lawyer fees is INSANE. It doesn't encourage a pursuit of justice, quite the opposite in fact.

    This helped me understand John Oliver's episode because i didn't know even if you won you still had to pay all your own fees, but you cleared that up for me right away haha, didn't realise that about America.

    This is basically what happens in India all the time. You cannot even make a funny and yet true statement about someone without being sued for Defamation and end up losing in India Courts (not all the time. Unless you are poor. You lose all the time).
